01Agreement to These Terms

These Terms of Use ("Terms") govern your access to and use of nbdc.online (the "Site"), operated by National Business Data and Claims ("NBDC," "we," "us," or "our"), and your use of our unclaimed property research and claim services.

By using the Site or submitting a request, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or our services.

02Eligibility

You must be at least 18 years old and able to enter into a binding agreement to use our services. We may accept or decline any request at our discretion.

If you submit a request on behalf of a business, estate or other person, you confirm that you have the authority to do so, and you agree to provide proof of that authority if a claim is filed.

03Our Services

NBDC researches and investigates unclaimed property, such as dormant accounts, uncashed checks, deposits, refunds and insurance proceeds held by the State of Texas through the Texas Comptroller of Public Accounts, and, with your authorization, prepares and files claims to recover that property for you or your business.

Claims are filed in the name of the rightful owner. The state or property holder decides whether to approve a claim and when to pay it.

04Search Requests

When you submit a request, you agree that:

• All information you provide is true, accurate, current and complete
• You will promptly let us know if any of your information changes
• We may contact you by email or phone about your request and any property we find
• Submitting a request does not obligate you to use our claim services and does not by itself create a client relationship

We may decline or stop work on a request if information provided is false or misleading, or if these Terms are violated.

05Fees and Client Agreements

Our fee for filing and managing a claim for an individual is a flat $49.99 per claim. For a business, the fee depends on the claim amount: $99.99 for claims from $1,000 to $1,999, $199.99 for claims from $2,000 to $7,999, and 10% of the amount recovered for claims of $8,000 or more. We accept individual claims with an estimated value of $500 or more and business claims with an estimated value of $1,000 or more. Before we file any claim, we will provide a written client agreement that describes the property we have identified, our fee, how the fee is paid and your rights. We do not file a claim on your behalf until you have reviewed and signed that agreement.

When you pay a fee, please use the full name and email address shown on your client agreement, and include your client agreement number if you have it, so we can match your payment to your claim.

Refund guarantee. If the State of Texas does not approve a claim we have filed for you, we will respond to any requests from the Texas Comptroller, provide additional documentation and resubmit the claim as many times as reasonably possible. If, despite those efforts, the claim cannot be approved, we will refund the fee you paid for that claim in full.

If the terms of a signed client agreement differ from these Terms, the client agreement controls for the services it covers. Our fees and agreements are intended to comply with Texas law, including any limits Texas places on fees.

06Your Right to Claim Directly

You do not need to use NBDC, or any paid service, to recover unclaimed property. Texas allows owners to search for and claim their property directly from the Texas Comptroller's unclaimed property program at no cost. Our fee is for the research, investigation, documentation, filing and follow-up we provide.

07No Guarantee of Recovery

We cannot guarantee that property will be found, that a claim will be approved, or how long a state or holder will take to process or pay a claim. Amounts shown in public records are estimates and may differ from the amount actually paid.

08Not Legal or Tax Advice

NBDC is not a law firm and does not provide legal, tax or financial advice. Information on the Site and guidance we provide while handling a claim are for general informational purposes only. For questions about estates, probate, taxes or your legal rights, please consult a qualified attorney or tax professional.

09Acceptable Use

You agree not to:

• Use the Site for any unlawful, fraudulent or harmful purpose, including attempting to claim property that does not belong to you or someone you are authorized to represent
• Submit false information or impersonate any person or organization
• Send spam, automated submissions or malicious code through the Site or its forms
• Try to gain unauthorized access to the Site, its systems or other users' information
• Interfere with or disrupt the operation or security of the Site

10Intellectual Property

The Site and its content, including text, design, graphics, logos and the NBDC name and mark, are owned by or licensed to NBDC and are protected by intellectual property laws. You may view and print pages for your personal, non-commercial use. You may not copy, reproduce, modify, distribute or create derivative works from the Site's content without our prior written permission.

11Third-Party Links and Services

The Site may contain links to, or content from, third-party websites and services, including the Texas Comptroller's unclaimed property website. We do not control and are not responsible for their content, policies or practices. Accessing them is at your own risk and subject to their terms.

12Disclaimers

The Site and our services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free or secure.

13Limitation of Liability

To the fullest extent permitted by law, NBDC and its owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data or opportunities, arising from your use of the Site or our services, even if we have been advised of the possibility of such damages.

Where liability cannot be excluded, our total liability for any claim relating to the Site or our services is limited to the fees, if any, you paid to NBDC for the service giving rise to the claim.

14Indemnification

You agree to defend, indemnify and hold harmless NBDC and its owners, employees and contractors from any claims, damages, losses and expenses, including reasonable legal fees, arising from your violation of these Terms, information you provide that is false or misleading, or your misuse of the Site.

15Changes and Termination

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Your continued use of the Site or our services after an update means you accept the revised Terms.

We may suspend or discontinue the Site or your access at any time, with or without notice. Any signed client agreement remains governed by its own terms.

16Governing Law

These Terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law principles. If any part of these Terms is found unenforceable, the rest will remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later.
